{"id":145,"date":"2025-07-30T20:20:50","date_gmt":"2025-07-30T20:20:50","guid":{"rendered":"https:\/\/www.dwone.com.br\/dev1\/?page_id=145"},"modified":"2026-01-26T12:34:48","modified_gmt":"2026-01-26T12:34:48","slug":"condicoes-gerais","status":"publish","type":"page","link":"https:\/\/fglglobal.com\/en\/condicoes-gerais\/","title":{"rendered":"General Conditions"},"content":{"rendered":"<p><strong>SERVICE TERMS AND CONDITIONS<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Part I \u2013 Offer of services to customers<\/u><\/strong><\/p>\n<p>Definition: FGL Global Log\u00edstica Ltda. selling its services to its customers.<\/p>\n<p>&nbsp;<\/p>\n<p>The services sold or marketed mainly refer to:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>International sea transport;<\/li>\n<li>Cabotage (national sea transport);<\/li>\n<li>International air transport;<\/li>\n<li>International road transport;<\/li>\n<li>National road transport;<\/li>\n<li>Customs clearance;<\/li>\n<li>Warehousing in its various categories;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Or in summary: international logistics; foreign trade \u2013 with operations abroad and in Brazil.<\/p>\n<p>&nbsp;<\/p>\n<p>Glossary of technical terms for foreign trade: see the final part of this document.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>Commercial proposal<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Every service is offered to the customer through a commercial proposal, which brings detailed prices per service item and a validity for shipment.<\/p>\n<p>&nbsp;<\/p>\n<p>For this proposal, observe the following conditions:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Contract duration and termination:<\/li>\n<\/ol>\n<p>a.1) The conditions of the proposal, except prices, are valid for 12 (twelve) months, from the date of its acceptance, automatically extending for equal and successive periods. Any changes in the terms and conditions of this proposal will imply its revision.<\/p>\n<p>&nbsp;<\/p>\n<p>a.2) Any of the parties is assured the right to terminate this proposal at any time, without any penalty or burden, provided that the customer expresses this intention at least 30 (thirty) days in advance.<\/p>\n<p>&nbsp;<\/p>\n<p>a.3) For cases of cancellation of immediate shipments, the customer must express this intention within a period that does not imply payment of deadfreight by the Shipowner or Airline and, nor does it imply payments for aggregated services, specially contracted to attend their shipments. In these cases, the customer is obliged to make the due payment to FGL.<\/p>\n<p>&nbsp;<\/p>\n<p>a.4) If there are changes in scope and volume of business, the parties must reassess the cost, productivity and\/or prices to be practiced, always aiming at the financial and economic balance of the proposal.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Prices<\/li>\n<\/ol>\n<p>b.1) the prices and rates informed in the proposal are based on current market conditions at the time of quotation and will be reviewed with each shipment, and may be affected by unforeseeable future events or force majeure, always, however, maintaining good faith in negotiations.<\/p>\n<p>&nbsp;<\/p>\n<p>b.2) Any increase or incidence of new taxes and legal rates that may affect the services must automatically lead to a review of the values offered to reflect the respective legal alteration.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Prices x market<\/li>\n<\/ol>\n<p>Freight and component fees are conditioned to changes in the tariffs of shipping companies, airlines and road transport or other suppliers for the services object of the proposal, as well as subject to exchange rate fluctuations, without prior notice. Our rates were based on information received from the Customer. Should there be any discrepancy in this information, FGL reserves the right to revise the rates.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Booking cancellation fee: booking cancellations are subject to payment of a cancellation fee, taking into account the availability and demand for space and equipment globally. When applicable, if the booking is canceled within 10 days before the ETS, the cancellation fee applied will be US$ 1000.00. If the cancellation occurs after this (less than 10 days), the amount to be charged is US$ 1300.00. These values may vary at any time depending on the market situation.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Prices \u2013 tariff for LCL cargo<\/li>\n<\/ol>\n<p>For LCL cargo (loose cargo) the freight value is calculated by cubic meter or by weight, always considering the greater. The freight for LCL is subject to payment of minimum freight, that is, the minimum cubic capacity or weight = 1 m3 or 1 ton.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Local charges<\/li>\n<\/ol>\n<p>Local charges \u2013 at origin or destination \u2013 are subject to changes in values and nomenclatures, being passed on to the customer according to the charge of the shipowner\/airline or other supplier, thus configuring VATOS charge = Valid at the time of shipment, that is, charge to be made by the values practiced at the time of shipment or arrival of the cargo.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Services and customer\/FGL options; requirements of controlling bodies<\/li>\n<\/ol>\n<p>The Customer is aware that FGL maintains the freedom to define the conditions for execution of the service, at its sole discretion, which includes the total or partial subcontracting of third parties. All shipments will be made according to applicable international standards, with strict quality control within the process. FGL will not be responsible, under any title, for services provided by suppliers indicated or contracted by the customer, nor for any delays or extra expenses resulting from decisions or requirements of official bodies in Brazil or abroad, within the cargo clearance process.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Transit time<\/li>\n<\/ol>\n<p>Transit time and other dates informed are estimates and are subject to change, whether due to alteration or cancellation of ship stopovers or for any other reason of force majeure, such as stoppages, strikes, bureaucracy of government agencies etc. FGL is not responsible for delivery deadlines resulting from delays.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Customer obligations and declarations:<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>i.1) Maritime \u2013 import:<\/p>\n<p>&nbsp;<\/p>\n<p>i.1.1\u00a0\u00a0\u00a0\u00a0 Demurrage: For FCL shipments, the customer is responsible for returning empty containers in perfect condition of use (clean and odorless) within the agreed free time per<\/p>","protected":false},"excerpt":{"rendered":"<p>SERVICE TERMS AND CONDITIONS &nbsp;
